YOUR INDEMNIFICATION OBLIGATIONS Client agrees
to indemnify and hold Contracted Work Inc, its affiliates and their respective
employees, consultants and other agents harmless from and against any losses,
costs, damages or expense including reasonable attorneys' fees resulting
from claims or actions arising out of or in connection with Client's participation
in the Contracted Work Inc Bid Program, third party claims for infringement
of copyright or other intellectual property rights and violation of rights
of privacy and publicity. You agree that you are solely responsible for
defending any claim, and for payment of damages or losses resulting from
the foregoing to both a third party and to Contractedwork.com. LIMITATION
OF LIABILITY AND WARRANTY DISCLAIMER THE Contracted Work Inc WEB SITE, IS
AVAILABLE ON AN "AS IS" BASIS. Contracted Work Inc MAKES NO WARRANTY OF ANY
KIND, WHETHER EXPRESSED OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY
OR FITNESS OF ANY SERVICE PROVIDED BY Contraceted Work Inc FOR A PARTICULAR
PURPOSE INCLUDING, WITHOUT LIMITATION, THE BIDS, THE PROJECTS, THE CONTENTS
OF ANY WEB SITES OR PAGES, ANY TECHNICAL MALFUNCTION, COMPUTER ERROR, LOSS
OF DATA, DELAY IN OPERATION, COMPUTER VIRUSES, COMMUNICATION LINE FAILURE,
DESTRUCTION OR UNAUTHORIZED USE OR ACCESS TO ANY WEB SITES OR RECORDS, OR
OTHER INJURY DAMAGE OR DISRUPTION TO CLIENT. NOTWITHSTANDING THE FOREGOING,
SHOULD CONTRACTEDWORK.COM BE LIABLE FOR ANY REASON, CLIENT AGREES THAT IN
NO EVENT SHALL CONTRACTEDWORK.COM'S BE RESPONSIBLY FOR LIABILITY EVER. IN
NO EVENT SHALL CONTRACTEDWORK.COM BE LIABLE FOR ANY INDIRECT, INCIDENTAL,
CONSEQUENTIAL, SPECIAL OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATED TO
THIS AGREEMENT EVEN IF SUCH DAMAGES ARE FORESEEABLE AND WHETHER OR NOT CONTRACTEDWORK.COM
HAS BEEN ADVISED OF THE POSSIBILITY THEREOF. CONTRACTED WORK INC WILL NOT
BE LIABLE FOR, OR CONSIDERED TO BE IN BREACH OF OR IN DEFAULT, ON ACCOUNT
OF ANY DELAY OR FAILURE TO PERFORM AS ANTICIPATED BY THE PARTIES YOU FURTHER
AGREE THAT YOU WILL NOT HOLD CONTRACTEDWORK.COM RESPONSIBLE FOR ANY ACTS,
ERRORS, OR OMISSIONS OF ANY THIRD PARTY IN CONNECTION WITH THE CONTRACTED WORK INC
BID PROGRAM, CONTRACTEDWORK.COM WEB SITE, AND/OR SITES LINKED TO THROUGH
THE CONTRACTEDWORK.COM WEB SITE. CONTRACTEDWORK.COM RESERVES THE RIGHT TO
REJECT ANY CONTENT AT ANYTIME.
Payment Information: You agree to use a valid credit card Contracted Work Inc. accepts, ALL MEMBERSHIPS ARE BASED ON MONTHLY SUBSCRIPTION, CONTRACTEDWORK.COM WILL AUTOMATICALLY CHARGE YOUR ACCOUNT FOR RENEWAL OF YOUR MONTHLY MEMBERSHIP UNLESS CANCELLED 48 HOURS PRIOR TO RENEWAL DATE, Trial memberships will be billed for basic membership unless cancelled before rebilling date (7 days after signing up). CONTRACTED WORK INC reserves the right to increase fees or institute new fees at any time with reasonable notice posted in advance on the contractedwork web site. Chargebacks that are returned to Contracted Work will have a $25.00 chargeback fee and a $25.00 processing fee added to the account. All chargebacks are sent to collection and reported to credit agencies in the account holders local country.
